Constituents often contact my offices with questions about the length of time it takes to process a Social Security disability claim.  An application for Social Security Disability can take anywhere from six weeks to several years to handle, depending on a variety of factors.  The times below are estimates, but represent what people in Kentucky's Fourth District have experienced over the years:

Initial Processing - 8 to 12 weeks - Some cases are approved in this first step. If your case is denied at this level, you are encouraged to apply for Reconsideration within sixty days.

Reconsideration - 12 to 24 weeks - Like the Initial Processing, this is all done through paperwork. Officers at the Department of Disability Services may set up medical appointments or request further medical information.  If your case is denied at this level, you are encouraged to request a hearing in front of an Administration Law Judge.

Hearings and Appeals - 16 to 24 months - At this level, your claim will be heard by an Administrative Law Judge.  Even after the hearing, it can take a few weeks longer to get a decision. You may want to get an attorney or other qualified individual to help represent you in your hearing. If you are denied at this level, you can appeal your case to the Appeals Council.

Appeals Council - 24 to 36 months - The Appeals Council in Falls Church, Virginia, handles all claims at this level.  If your claim is not approved by the Appeals Council, your only option is to file a lawsuit if you want to continue your claim.  My office is unable to intervene in legal matters, so I cannot assist with any cases that go beyond the Appeals Council.
